A defendant in my court today pleaded guilty to theft.

It seems he was in the Magistrates' Court with his advocate, having just avoided custody by the skin of his teeth for another offence. In the general euphoria of having his (relative) freedom, he celebrated by stealing his advocate's iPhone 4.

His defence advocate for the theft of the iPhone mitigated that it wasn't his fault as his previous advocate should have known better than to put his phone down, it being likely that there would be thieves in a Magistrates' Court.

As you might imagine, such a speech in mitigation gave myself and my colleagues a good laugh but didn't have any effect on the sentence.
